Terms of Service
These Terms of Service govern your use of fiddl.art (the Platform). By accessing or using the Platform, you agree to these terms and represent that you have the legal authority to do so.
1. Accounts and Eligibility
You are responsible for your account activity, keeping your credentials secure, and making sure that anyone using your account follows these terms. You may not misrepresent your identity, business, age, location, payment information, or authorization to use uploaded materials.
2. Content Rights and Responsibility
You retain rights to your uploads and creations, subject to rights held by others. You are solely responsible for the prompts, assets, datasets, reference images, training images, and creations that you upload, generate, publish, unlock, or use.
By uploading, generating, publishing, or using content on the Platform, you confirm that you have all rights, permissions, licenses, and consents needed for that content and for the way you use it.
3. Public and Private Creations
Content you choose to publish publicly on fiddl.art may be highlighted within the product experience, galleries, feeds, search results, previews, official social channels, or marketing materials. Sharing public creations helps the community discover new artists and features.
Private images, uploads, and draft creations stay private to your account unless you explicitly share them. We do not sell private uploads. We may review private or public content when needed to operate the service, enforce these terms, respond to support or legal requests, prevent abuse, or protect users and partners.
4. License to Operate the Platform
By posting, uploading, or generating content on the Platform, you grant fiddl.art and Progredia Futura a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, adapt for technical formatting, moderate, distribute, and promote that content as needed to operate, secure, market, and improve the Platform.
This license ends when you delete the content, except where continued retention is reasonably required for backups, legal compliance, dispute handling, safety enforcement, audit logs, or legitimate business records.
5. Acceptable Use
You may not use fiddl.art to create, upload, publish, sell, unlock, promote, distribute, or otherwise make available prohibited content or activity, including:
- Illegal content or activity, fraud, scams, deceptive claims, evasion of platform controls, card testing, sanctions violations, or activity involving prohibited jurisdictions or restricted persons.
- Pornography, sexually explicit content, mature-audience content designed for sexual gratification, fetish content, sexual services, adult live-chat style content, or AI-generated content that meets those criteria.
- Sexualized minors, child sexual abuse material, grooming, age-play, or any content that exploits, endangers, or sexualizes a child or a person presented as a child.
- Non-consensual intimate imagery, sexual deepfakes, image-based abuse, voyeuristic content, or sexualized content using a real person's likeness without clear consent.
- Harassment, threats, hate, extremist content, graphic violence, self-harm instructions, or content that encourages harm against people or protected groups.
- Content that infringes or facilitates infringement of copyright, trademark, publicity, privacy, or other rights, including unauthorized use of licensed characters, brands, celebrities, artists' work, private images, or training data.
- Impersonation, misleading synthetic media, false endorsement, fake documents, identity misuse, or attempts to deceive people about whether media is real, authorized, or official.
- Attempts to sell, transfer, or monetize content, models, prompts, accounts, credits, or access in a way that violates these terms, payment processor rules, or applicable law.
6. Adult Content
Fiddl.art is intended for lawful, non-adult creative use. You may not use the Platform, Platform credits, payments, subscriptions, public feeds, model pages, creator features, or unlock features for pornography, sexually explicit content, adult services, or AI-generated adult content. We may block, remove, or redirect adult-content workflows at our discretion.
7. Custom Models and Likeness Rights
If you upload training images, reference images, face images, brand assets, or datasets, you must own them or have documented permission from the rights holder and any identifiable person depicted. You may not train, publish, sell access to, or promote models intended to imitate a private person, creator, celebrity, brand, or protected work without authorization.
8. Payments, Credits, and Creator Features
Purchases, subscriptions, credits, unlocks, rewards, referrals, and creator features may be limited, reversed, withheld, or disabled where required by law, risk controls, payment processor rules, abuse prevention, disputes, refunds, chargebacks, or suspected policy violations.
Credits are a limited license to use Platform features. Credits have no cash value, are not stored value, are not money transmission, and may not be sold or transferred outside the Platform unless a separate written payout program expressly says otherwise.
9. Takedowns and Rights Complaints
If you believe that content on fiddl.art infringes your rights, violates your privacy or likeness rights, or breaks these terms, contact us at social@fiddl.art. Include the relevant URL, a detailed description of the issue, and proof of ownership or authority where applicable.
We may remove or restrict content while reviewing a complaint. We may require proof of ownership, identity, consent, or authorization before restoring content or taking further action.
10. Enforcement
We may moderate, filter, hide, remove, restrict, or delete content; disable public visibility; suspend features; block payments or redemptions; preserve records; report unlawful content; or suspend or terminate accounts when we believe these terms, platform rules, payment processor requirements, or applicable law may have been violated.
We may act without prior notice where needed to protect users, payment partners, rights holders, the public, or the Platform. We are not liable for enforcement actions taken in good faith.
11. Third-Party Services and Rules
Some Platform features rely on third-party models, infrastructure, payment processors, app stores, authentication providers, or other services. Your use of those features may be subject to additional rules, and we may change, disable, or restrict features to comply with third-party requirements.
12. No Warranties - No Liability
The Platform is provided as is and as available. To the fullest extent permitted by law, fiddl.art, Progredia Futura, and our team disclaim all warranties and are not liable for any damages that result from your use of the Platform, including loss of data, profits, credits, content, opportunities, discoverability, rankings, model access, payment access, or reputation.
13. Changes to Terms
We may update these terms from time to time. Changes will be posted on this page, and your continued use of fiddl.art after the updated terms become effective constitutes acceptance of the updated terms.
